Privacy Policy
Thank you for reviewing the NE Construction Privacy Policy (the “Policy”).
The terms “NEC,” “we,” “our,” and “us” refer to NE Construction, LLP, a Texas limited liability partnership, and its affiliates. “You” or “your” refers to you as a user of our services described in this Policy.
ABOUT THIS POLICY
We respect your privacy and are committed to protecting personal data through our compliance with this Policy. This Policy describes how we collect, process, retain, use, and disclose personal data about you when providing services to you through our website and the pages thereof, applications and software applications operated by us or on our behalf through our website that link to this Policy (our “Services”), and certain services provided by third parties (“Vendors”) through links on our website.
With respect to services provided by a Vendor, the applicable Vendor may have its own privacy policy governing information that the Vendor collects or processes. You should review the applicable Vendor’s privacy policy for information concerning the Vendor’s privacy practices. For example, the “Contractors” page of the NEC website provides access to bid opportunities through BuildingConnected, an Autodesk company. The “Careers” page provides access to employment opportunities through Paycom. The applicable Vendor privacy policies are available through the respective Vendor websites.
This Policy applies only to information we collect:
- Through the Services;
- In communications, including email, text, chat, and other electronic messages, between you and the Services; and
- When you interact with applications operated by or on behalf of NEC on third-party websites or services, if those applications include a link to this Policy.
This Policy does not apply to information collected:
- By us through other means, including on another website operated by us or by a third party that does not link to this Policy; or
- By a third party, including an affiliate or Vendor, through an application, website, service, or content that is not operated by NEC, even if that application, website, service, or content is accessible through or linked from the Services.
We may provide additional or different privacy notices for particular features, services, activities, or categories of information. Those notices will govern to the extent they conflict with this Policy.
DATA COLLECTED
Where applicable law requires consent to a particular collection, use, disclosure, or other processing of personal data, NEC will obtain consent in accordance with applicable law. Your use of the Services does not, by itself, constitute consent to processing for which applicable law requires consent.
Children’s and Teens’ Data
Our Services are not directed to children or teens. We do not knowingly collect personal data from children or teens in circumstances in which applicable law requires parental or other authorization. If we learn that we have collected personal data in violation of applicable law, we will take appropriate steps to delete or otherwise address that information as required by applicable law.

Certain information may be considered “sensitive data,” “sensitive personal data,” or a similar category under applicable law. Depending on the circumstances, sensitive data may include information such as certain identification information, precise geolocation, biometric information, health information, information concerning race or ethnicity, religious beliefs, citizenship or immigration status, or other categories identified by applicable law.

Aggregated and De-Identified Information
NEC may create or receive aggregated, statistical, or de-identified information that does not reasonably identify an individual. NEC may use such information for legitimate business purposes, including understanding use of the Services, improving operations, and analyzing business activities. If NEC combines or associates information that does not identify an individual with personal data so that the resulting information identifies or is reasonably capable of being associated with an individual, NEC will treat the resulting information as personal data as required by applicable law.

NEC does not control the privacy practices of third parties acting independently of NEC. Information collected directly by a third party is governed by that third party’s privacy policy. For example, employment applicants may interact directly with Paycom, and contractors or other business participants may interact directly with BuildingConnected. Your Rights and Choices
Depending on where you live and whether applicable law applies to you, you may have certain rights concerning your personal data. The scope of these rights, and exceptions to those rights, vary by state and may also depend on the nature of your relationship with NEC.
- Access: You may have the right to confirm whether NEC processes personal data concerning you and to access personal data that NEC processes about you.
- Correction: You may have the right to request correction of inaccuracies in personal data maintained by NEC, taking into account the nature of the personal data and the purposes for which NEC processes it.
- Deletion: You may have the right to request deletion of personal data concerning you, subject to exceptions provided by applicable law.
- Data Portability: You may have the right to obtain certain personal data in a portable format, to the extent required by applicable law.
- Opt-Out Rights: Certain state privacy laws provide rights to opt out of:
- The sale of personal data;
- Targeted or interest-based advertising; and
- Certain forms of profiling that produce legal or similarly significant effects.
NEC does not sell personal data and does not currently engage in targeted advertising. NEC also does not currently conduct solely automated profiling that produces legal or similarly significant effects. Accordingly, there is presently no sale or targeted-advertising processing from which NEC provides an opt-out under this Policy. If NEC’s practices change, NEC will update this Policy and provide any opt-out mechanisms required by applicable law.
NO DISCRIMINATION
To the extent required by applicable law, NEC will not discriminate against an individual for exercising a privacy right provided by applicable law.
TEXAS RESIDENTS
Texas residents may have rights under the Texas Data Privacy and Security Act and other applicable Texas law, subject to statutory thresholds, exemptions, and exceptions. Where applicable, those rights may include access, correction, deletion, data portability, and the right to opt out of certain processing, including targeted advertising, the sale of personal data, or certain profiling.
NEC will process privacy rights requests in accordance with applicable Texas law and any other applicable law. Requests may be submitted through the privacy rights request mechanism on the NEC website or by email to contactus@neconstruction.net, with the subject line “Privacy Rights Request.”
COLORADO RESIDENTS
The Colorado Privacy Act applies only to organizations meeting specified statutory thresholds and subject to applicable exemptions. Based on NEC’s current data-processing activities and applicable statutory thresholds, NEC does not currently consider itself subject to the Colorado Privacy Act. NEC will periodically review the applicability of Colorado privacy law and will update this Policy and its practices if the law becomes applicable to NEC.
OTHER STATE PRIVACY LAWS
Residents of other states may have rights under state privacy laws that apply to NEC or to particular categories of personal data or processing. NEC will provide rights required by applicable law. The existence and scope of a particular right may depend upon the applicable statutory threshold, exemption, the nature of the individual’s relationship with NEC, and the type of personal data involved. Nothing in this Policy is intended to limit a right that cannot lawfully be limited under applicable law.
COOKIES AND OTHER TECHNOLOGIES
You can set your browser or device to refuse some or all cookies or similar technologies or to notify you when such technologies are being used. If you disable cookies or similar technologies, some features of the Services may not function properly.
Some browsers or devices may provide privacy signals, including “Do Not Track” or similar signals. NEC will respond to such signals to the extent required by applicable law.
NEC does not currently use cookies or similar technologies for targeted advertising or to sell personal data.
LOCATION DATA CHOICES
Where a Service collects location information through a device, you may be able to control collection through your device or browser settings. NEC does not require precise geolocation information for ordinary use of its website. If a particular Service requires location information, the applicable Service may provide additional information concerning the collection and use of that information.
HOW WE PROTECT PERSONAL DATA
We use commercially reasonable administrative, physical, and technical measures designed to protect personal data from accidental loss or destruction and from unauthorized access, use, alteration, or disclosure. No website, electronic storage system, application, or online service is completely secure, however, and NEC cannot guarantee the absolute security of personal data transmitted to, through, or in connection with the Services. Email, text messages, and other electronic communications may not be secure. You should exercise appropriate care in deciding what information to transmit through those channels.
The safety and security of personal data also depends on you. You are responsible for taking reasonable steps to protect information that you use to access the Services and for avoiding disclosure of sensitive information through unsecured communications channels.
HOW WE RETAIN PERSONAL DATA
NEC retains personal data for no longer than reasonably necessary to accomplish the purposes for which it was collected, unless a longer retention period is permitted or required by law. Retention periods may vary depending on the nature of the information and the purposes for which it is maintained. NEC may retain information as necessary to:
- Maintain business and financial records;
- Comply with legal, regulatory, tax, accounting, insurance, or reporting requirements;
- Establish, exercise, or defend legal claims;
- Resolve disputes or respond to complaints;
- Maintain the security and integrity of systems and operations;
- Prevent fraud or other unlawful activity; or
- Fulfill other legitimate business purposes permitted by applicable law.
In determining retention periods, NEC considers the amount, nature, and sensitivity of personal data, the purposes for which it is processed, the potential risk of harm from unauthorized use or disclosure, whether the purposes can be achieved by other means, and applicable legal and business requirements.
When personal data is no longer reasonably necessary for the purposes for which it is maintained, NEC will delete, destroy, de-identify, or otherwise dispose of the information as appropriate and as permitted or required by law.
CHANGES TO THIS POLICY
NEC may update this Policy from time to time. The date the Policy was last updated appears at the top of the Policy.
